Sitoo works actively against unsolicited email (Spam). Sending unsolicited email (Spam) with Newsletter Studio is a serious violation of the End User License Agreement (EULA). Sitoo informs the users on laws and regulations that need to be complied with. We have also incorporated technical obstacles in the Newsletter Studio software specifically designed to prevent unsolicited email (Spam).
Technical obstacles in Newsletter Studio
In Newsletter Studio, custom headers (SMTP) can not be added which is a typical technique for distorting, hiding or shadowing information about the origin or transfer of the email.
In Newsletter Studio it is not possible to send emails with different senders to different recipients (in batch), which is a common technique for sending spam.
Do not send unsolicited email
Sending unsolicited email (Spam) is most likely in violation of the law. The user of Newsletter Studio is ultimately responsible for complying with CAN-SPAM Act and other laws and regulations for sending emails.
If the recipient has not verifiably granted deliberate permission to receive the email, it can be classified as spam.
To avoid having your newsletter classified as spam you should consider the following:
- BE CLEAR ON WHO THE SENDER OF THE NEWSLETTER IS!
- Always get the consent of the recipient! - MAKE SURE THAT THE MAILING LIST IS 100% OPT IN
- Do not use purchased email lists
- Make sure that the subject line and email content doesn't contain false or misleading information
- The content of the newsletter should be reasonable to the recipient, i.e. references to websites offering sex or Viagra will most likely be classified as spam
- Comply with laws and regulations for sending emails
Violation of contract with legal consequences
In the End User License Agreement (EULA) between the license owner (a person or legal entity) and Sitoo it is clear that sending unsolicited email (Spam) with Newsletter Studio is a serious violation of contract.
If it comes to the knowledge of Sitoo that a Newsletter Studio license owner is in violation of current laws and regulation for sending emails, Sitoo will declare the contract to be invalid and also report the license owner to the appropriate authorities which might result in legal consequences for the license owner.
